Terms of Service

Effective date: 1 August 2026

These terms are an agreement between you and Anphase Limited, a New Zealand company, NZBN 9429041744017, which operates Mwenje ("we", "us", "our"). Our registered details are on the public register at that link. These terms cover the Mwenje website and the signage service you sign in to. By creating an account or using the service, you agree to them.

What Mwenje is

Mwenje is digital signage: you build layouts, say when they play, and connect screens that play them. Screens keep their own copy of what they are meant to show, so they carry on through a dropped connection and report back once they are reconnected.

Your account

You need an account to use the service. When you create one:

  • Give us accurate details, and keep them current.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • Tell us promptly if you think someone else has got into it.
  • You must be 18 or older, and if you are signing up for an organisation you must be allowed to agree to these terms on its behalf.

Accounts belong to the organisation they were created for. Whoever administers that organisation controls who is invited, what each person can do, and when access ends.

What you may put on your screens

Your content stays yours. You give us permission to store it, process it and send it to the screens you connect, which is what running the service requires, and nothing further.

You are responsible for what you display. By uploading content you confirm you have the rights to use it, and you agree not to use Mwenje to:

  • Break the law, or display content that is illegal in the place it is shown.
  • Infringe anyone's copyright, trade marks or other rights.
  • Display material that harasses, defames or threatens someone.
  • Interfere with the service, get into parts of it you are not entitled to, or try to break its security.
  • Resell or rebrand the service as your own without our written agreement.

If content on an account breaks these rules, we may remove it or suspend the account. Where we can, we will tell you first and give you a chance to put it right.

Mwenje is provided as it is and as available, and you use it, and rely on what it puts on your screens, at your own risk. The checking is yours to do: that what you schedule is correct, and that it is appropriate for the place it will play. We do not review your content before it goes up, and a screen shows what you gave it whether the prices are still current or not.

Fees

Mwenje is free while it is in early release. There is no plan to choose, no card to enter, and nothing to pay.

We expect to charge for it eventually. When we do, the plans and prices will be published on this page, and we will tell account holders before any charging begins. Until that happens, nothing in these terms obliges you to pay us anything.

Availability

We work to keep Mwenje running, but we do not promise it will be available without interruption. Maintenance, upgrades, provider outages and faults all happen. We will give notice of planned maintenance where we reasonably can.

Screens hold their own content and schedule, so a screen keeps playing through a loss of connection to us. Changes you make while a screen is offline reach it once it reconnects.

We aim for 99.5% availability of the console, measured over a calendar month. That is an aim, not a commitment: we do not guarantee it, and we do not offer service credits if we fall short of it.

It is worth being clear about what that number covers. It is the console, the part you sign in to. Your screens do not depend on it minute to minute, so an hour in which we are unreachable is an hour you cannot make changes, not an hour of blank screens.

Ending it

You can stop using Mwenje and close your account at any time.

We may suspend or close an account that breaks these terms, or where we are required to by law. If we close an account for any other reason, we will give you reasonable notice first.

Closing an account starts a 30 day window. During it, email support@mwenje.com and we will send you a copy of your layouts and the media you uploaded, or put the account back as it was. There is no self-service export yet, so ask and we will do it by hand. After 30 days we delete the content and it cannot be recovered.

Limits on our liability

Mwenje is provided as it is. To the extent the law allows, we exclude the implied warranties that would otherwise apply, and we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data arising from your use of the service.

If you are using Mwenje for business purposes, the Consumer Guarantees Act 1993 does not apply, and you agree it is fair and reasonable that it is excluded. Nothing in these terms limits rights that cannot lawfully be limited.

Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms as the service changes. The current version always lives on this page with its effective date at the top. If a change materially affects you, we will let account holders know before it takes effect. Continuing to use Mwenje after that means you accept the updated terms.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from them.
